1. Acceptance and Scope
1.1 Agreement to these terms
By creating a BinGo Auctions account, placing a bid, or otherwise participating in any auction on the platform, you agree to this Bidder Agreement ("Agreement"). If you do not agree, do not place bids or use the bidding features of the Service.
1.2 Relationship to the Terms of Service
This Agreement supplements and is incorporated into the BinGo Auctions Terms of Service ("Terms"), available at /legal/terms. The Terms govern your account, acceptable use, payments, privacy, disclaimers, and dispute resolution at a platform level. This Agreement provides the additional rules specific to your role as a Bidder. Where a provision in this Agreement conflicts with the Terms, this Agreement controls as to Bidder-specific matters.
1.3 Who operates the platform
The Service is operated by RDW, LLC, an Arkansas limited liability company, doing business as BinGo Auctions ("we," "us," "our"). When this Agreement refers to "you" or "Bidder," it means the person who has registered a BinGo Auctions Bidder account and is placing or considering placing bids.
1.4 Who you are buying from
BinGo Auctions is the seller and auctioneer of record for every lot. Each item on BinGo Auctions is listed by us as the seller and auctioneer. When you win a bid, you enter a purchase contract with BinGo Auctions (RDW, LLC). We take title to and sell the goods directly; items are sold in the condition described, subject to the AS-IS terms below.
2. Eligibility and Account Rules
2.1 Eligibility requirements
To place bids on BinGo Auctions you must:
- Be at least 18 years old.
- Be a resident of the United States.
- Have the legal capacity to enter into binding contracts under the laws of your state.
- Provide accurate, complete, and current information when creating your account.
2.2 One account per person
You may only hold one BinGo Auctions Bidder account. Your BinGo Auctions account gives you access to every BinGo Auctions auction — one login gives you access to all auctions. Operating multiple Bidder accounts (whether to circumvent a suspension, gain a bidding advantage, or for any other reason) is grounds for permanent suspension of all accounts associated with you, including by IP address, device fingerprint, phone number, or payment method.
2.3 Account accuracy
You agree to keep your profile information — name, email, phone number, and payment method — accurate and current. False or unverifiable contact details are grounds for account termination. If your contact information changes, update your account promptly.
2.4 Account security
You are responsible for all activity that occurs under your credentials. Keep your password confidential and do not share your account. If you believe your account has been accessed without authorization, notify us immediately at legal@bingoauctions.com.
3. Bids Are Binding Offers
3.1 Nature of a bid
Every bid you place is a binding, irrevocable offer to purchase. Placing a bid means you are committing to buy the item at that price if no higher bid is submitted before the auction closes. The auction software displays your maximum bid, manages proxy bidding, and updates the current high bid automatically.
3.2 Winning bid creates a contract
When an auction closes and you are the highest bidder, a binding purchase contract is formed between you and BinGo Auctions at the hammer price. You are obligated to pay and to pick up the item.
3.3 Payment authorization
By placing a bid, you authorize BinGo Auctions — processing payments through Square — to charge your saved payment method for:
- The winning bid amount (hammer price).
- Any buyer's premium set by BinGo Auctions and disclosed before you bid.
- Applicable sales tax calculated at the time of charge.
Payment is processed at auction close through BinGo Auctions' Square account. BinGo Auctions, through Square, is your merchant of record for the transaction.
3.4 No bid retraction
You cannot retract a bid once placed. The auction software does not support bid cancellation, and no staff member of BinGo Auctions has authority to remove a live bid on your behalf. If you believe you placed a bid in significant error (for example, a genuine technical malfunction, not a change of heart), contact us through the platform immediately; BinGo Auctions has sole discretion whether to accommodate such a request and is under no obligation to do so.
4. Identity Verification
4.1 When we may require verification
BinGo Auctions may require you to complete identity verification before a bid is accepted or before items are released — for example, for high-value bids or where we suspect fraud — using a third-party verification provider. If verification is required and you decline or do not pass it, the affected bid may be held or rejected and your account may be restricted.
4.2 What we receive
Where verification is performed by a third-party provider, that provider processes your identity documents on its own infrastructure under its own terms and privacy policy. We receive only the verification result (verified / not verified / requires review); we do not receive, store, or process copies of your identity documents or facial images.
4.5 Refusal to verify
If you decline to complete verification when required, the pending bid will be cancelled and you will not be able to place bids above the threshold until verification is complete. Repeated refusal or submission of fraudulent ID materials is grounds for account suspension.
5. Items Sold AS-IS
5.1 No warranty
BinGo Auctions makes no representations and provides no warranties regarding any item listed on the platform. Items are sold in "as-is, where-is" condition. Listing descriptions and photos are provided by BinGo Auctions in good faith but may not capture every defect, imperfection, or condition issue. By bidding, you acknowledge that you have reviewed the available listing information and are bidding with that knowledge.
5.2 Item condition
Except for any specific representation BinGo Auctions makes about an item in the listing, all warranties, representations, or guarantees about an item's condition, authenticity, completeness, or fitness for a particular purpose are disclaimed. Items are sold in "as-is, where-is" condition as described above.
5.3 Inspect before you bid
Where preview opportunities are disclosed in the listing, we strongly encourage you to inspect items before placing a bid. Inability to preview does not reduce your obligation to pay if you win.
6. Inspect at Pickup; Refunds
6.1 Inspect before you accept
Inspect every item at pickup before you accept it. If an item materially differs from what was represented in the listing description or photos in a significant, substantive way, tell our staff at pickup and decline it — we will refund that lot on the spot to your original payment method. Once you accept and take an item, the sale is final and there is no separate post-pickup dispute window.
6.2 What qualifies for a refund
A refundable item requires that: (a) the item's condition is substantially worse than described — not merely that it is used, shows age-appropriate wear, or that you have changed your mind; or (b) the item is materially different from what was listed (for example, a completely wrong item was placed in your bin). Minor cosmetic differences visible in the listing photos or consistent with a reasonable reading of the condition notes do not qualify.
6.3 How refunds are handled
BinGo Auctions staff review the item against the listing description and photos at pickup and make the determination. Approved refunds are processed through Square back to your original payment method. This on-the-spot review is your remedy for a not-as-described item; a chargeback through your card issuer remains available subject to your card network's rules.
7. Pickup-Only Fulfillment
7.1 All sales are pickup-only
BinGo Auctions does not offer shipping or delivery unless we explicitly state otherwise in a specific listing. You are responsible for arranging transportation of any item you win.
7.2 Pickup window obligations
BinGo Auctions posts a pickup schedule in the listing and in your auction-close notification. You are required to collect your items within that window. If you cannot make the primary pickup window, contact us through the platform as early as possible; accommodations are at our discretion.
7.3 No-show forfeiture
If you do not pick up your item(s) within the posted pickup window and do not make alternate arrangements approved by BinGo Auctions, your payment is forfeited and the item may be relisted. BinGo Auctions will not issue a refund in connection with a no-show forfeiture. Any per-item no-show fee, if applicable, is disclosed before you bid.
7.4 Condition at pickup
Inspect your item at the time of pickup. If you have concerns, note them before leaving the pickup location and initiate the dispute process while you are still on-site if possible. Leaving the pickup location with an item you intend to dispute without documenting the issue contemporaneously may reduce your ability to establish a qualifying dispute.
8. Payment Failure
8.1 Consequences of failed payment
If your saved payment method is declined at auction close, we will attempt to notify you and provide a brief window to update your payment method. If payment is not successfully collected within that window, BinGo Auctions may cancel the transaction and relist the item at no obligation to you. You will not be entitled to the item and will receive no compensation for any bid increment you contributed.
8.2 Effect on account standing
A single payment failure from a declined card does not automatically result in suspension. However, a pattern of payment failures — particularly where items are won and then not paid for — is grounds for account restriction or suspension. Accounts that owe outstanding balances may be restricted from placing new bids until the outstanding amount is resolved.
9. Prohibited Bidder Conduct
9.1 Shill bidding and collusion
You agree not to engage in shill bidding (bidding on items you have a financial interest in to artificially inflate the price), bid suppression (agreeing with other bidders to keep bids artificially low), or any other form of auction manipulation. These practices are prohibited under platform rules and may violate applicable state auction fraud and consumer protection statutes.
9.2 Automated bidding tools
You agree not to use bots, scripts, automated bidding software, or any other automated tool to interact with the bidding system without our prior written consent. Proxy bidding features built into the platform are permitted.
9.3 Scraping and data harvesting
You agree not to scrape, crawl, or systematically extract listing data, pricing data, or other platform content using automated means. Accessing the platform through unofficial APIs, reverse-engineered endpoints, or bulk download tools is prohibited.
9.4 Prohibited items
You agree not to bid on or facilitate the acquisition of items that appear on the BinGo Auctions Prohibited Items list (Schedule A), available at /legal/prohibited-items. Knowingly bidding on prohibited items is grounds for suspension.
9.5 Impersonation and false information
You agree not to impersonate another person, use a false name, or provide false contact information. Winning bidders who cannot be reached for pickup due to false contact information forfeit their items.
9.6 Chargeback abuse
Initiating a chargeback with your card issuer for a valid, completed transaction — meaning you collected the item and it matched the listing — constitutes abuse. Accounts with a pattern of abusive chargebacks are subject to suspension, permanent ban, and referral to our fraud detection processes. A chargeback filed in good faith after the dispute process has been exhausted and denied is not abuse.
10. SMS Communications and TCPA Consent
10.1 Optional SMS opt-in
We may send SMS text messages for bid alerts, outbid notifications, auction-close confirmations, pickup reminders, and related transactional communications, but only if you affirmatively opt in to SMS communications during account setup or in your notification settings.
10.2 Consent record
When you opt in to SMS, we record your consent, including the timestamp, the consent disclosure language presented to you at the time, and the phone number you provided. This record is maintained for compliance purposes and may be used to demonstrate consent if required.
10.3 Opt-out
You can opt out of SMS communications at any time by replying STOP to any BinGo Auctions text message, or by updating your notification preferences in the app. Opting out of SMS does not affect your ability to use the Service or receive transactional communications by other means (email, push notification).
10.4 Message frequency and carrier disclosure
Message frequency varies based on your auction activity. Standard message and data rates from your mobile carrier may apply. BinGo Auctions is not responsible for carrier charges.
11. Account Suspension and Termination
11.1 Grounds for suspension or termination
We may suspend, restrict, or permanently terminate your account for any of the following:
- Violation of this Agreement, the Terms, or any other BinGo Auctions policy.
- Fraud or attempted fraud.
- Shill bidding, collusion, or auction manipulation.
- Chargeback abuse.
- Non-payment of amounts owed.
- Operating multiple accounts.
- Submission of false identity information.
- Conduct that threatens the safety, trust, or integrity of the Service.
- Instruction from law enforcement or a court order.
11.2 Notice before suspension
We will generally provide advance notice before suspending an account, except where immediate action is required to prevent ongoing harm to the platform or other users. In those cases, suspension may occur first and notice will follow promptly.
11.3 Effect of termination
Upon termination of your account: any open bids are cancelled, any items you have won but not yet paid for are forfeited to BinGo Auctions, and access to your account history is removed (though records are retained by us as described in the Privacy Policy). Termination does not relieve you of obligations already incurred, including payment for items won before termination.
11.4 Appeals
If you believe your account was suspended in error, email legal@bingoauctions.com with a description of your account and the basis for your appeal. We will review and respond within a reasonable time, though we are not obligated to reinstate any account.
12. Communications
12.1 Transactional communications
We send transactional communications — bid confirmations, outbid alerts, auction-win notifications, payment receipts, pickup reminders, dispute updates — by email and, if you have opted in, by push notification or SMS. These communications are required for operation of the Service. You cannot unsubscribe from transactional messages while your account is active.
12.2 Marketing communications
If you have opted in to marketing communications, we may send you promotional emails about new features, promotions, or BinGo Auctions news. Every marketing email includes a one-click unsubscribe link. Unsubscribing from marketing communications does not affect your receipt of transactional messages.
13. Disputes About Items and Pickups
13.1 How disputes are handled
Disputes about items, pickups, item condition, or refunds are handled by BinGo Auctions through the dispute process described in Section 6. We review your evidence and make a determination as set out in these Terms.
13.2 Escalation
If you believe a dispute determination was made in error, or that our handling of a dispute was inconsistent with these Terms, you may notify us at legal@bingoauctions.com. We will review the complaint, but we do not commit to a particular outcome and cannot guarantee a refund in any specific case.
13.3 Recourse
Your recourse in connection with an item or pickup dispute is through the dispute process described in Section 6, your card issuer's chargeback rules, and applicable consumer protection laws.
14. Arbitration and Class Action Waiver
Agreement to arbitrate. Any dispute, claim, or controversy between you and BinGo Auctions arising from or related to this Agreement, the Terms, or your use of the platform shall be resolved by binding individual arbitration rather than in court, except as stated below. This agreement to arbitrate mirrors and is incorporated from Terms §17, which you should read in full.
Exceptions. Either party may bring claims in small claims court if they qualify. Either party may seek emergency injunctive relief in a court of competent jurisdiction. Nothing prevents either party from filing a complaint with a government regulator.
Arbitration rules. Arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org. Arbitration shall take place in Arkansas or, at your election, by videoconference. The arbitrator's award is final and binding.
Class action waiver. YOU AND BINGO AUCTIONS WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY. If this waiver is found unenforceable for a particular claim, that claim must be litigated in court, not arbitrated.
Opt-out right. You may opt out of arbitration by sending written notice to legal@bingoauctions.com within 30 days of first agreeing to these Terms. Your notice must include your name, account email, and a clear statement that you are opting out of arbitration.
15. Governing Law
This Agreement is governed by the laws of the State of Arkansas, without regard to its conflict-of-law principles. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Arkansas, and you consent to personal jurisdiction in those courts.
16. Severability and Entire Agreement
If any provision of this Agreement is found unenforceable, that provision is modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions continue in full force. This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and RDW, LLC regarding your role as a Bidder in BinGo Auctions auctions and supersedes all prior agreements, representations, and understandings on that subject.
17. Changes to This Agreement
We may update this Agreement from time to time. When we do, we will update the effective date and version number at the top of this page. For material changes that meaningfully affect your rights or obligations, we will provide at least 30 days' advance notice by email. Your continued use of the bidding features of the Service after the effective date of an updated Agreement constitutes acceptance of those changes.
