DMCA Policy and Copyright Takedown Procedure

1. Our Commitment to Copyright Compliance

RDW, LLC respects intellectual property rights and is committed to maintaining that standard across all content on BinGo Auctions. This policy describes how we respond to claims of copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

We operate as a provider of online services that host content, including auction listing photographs and descriptions. To the extent applicable, we follow the procedures set out in Section 512(c) of the DMCA, which provide a framework for responding to claims of copyright infringement. This policy is our implementation of those procedures.

Our DMCA-related IP policies are also referenced in the Terms of Service at §11, available at /legal/terms.


2. Designated Agent

We have designated an agent to receive takedown notices under Section 512(c)(2) of the DMCA. Our Designated Agent information is:

Important: Email is our preferred and fastest channel for receiving DMCA notices. Notices sent by email to legal@bingoauctions.com will receive a faster response than notices sent by postal mail.

We have registered (or are in the process of registering) our Designated Agent with the United States Copyright Office at https://www.copyright.gov/dmca-directory as required by Section 512. Registration with the Copyright Office is separate from the submission of individual takedown notices and is required to maintain our safe-harbor eligibility.


3. What Content Can Be Reported

This DMCA policy covers claims that content hosted on https://bingoauctions.com or in our mobile applications infringes a copyright you own or are authorized to act on. The most common type of content we receive infringement claims about is auction listing photographs.

This policy covers copyright claims only. If your concern involves:

  • Trademark infringement — contact us at legal@bingoauctions.com with "Trademark Complaint" in the subject line. See Section 9.
  • Right of publicity / name and likeness (NIL) — contact us at legal@bingoauctions.com with "Right of Publicity Complaint" in the subject line. See Section 10.
  • Sale of counterfeit or replica goods — this is a Prohibited Items issue. Contact us at legal@bingoauctions.com with "Counterfeit Goods Report" in the subject line.

These issues are handled through separate review processes, not through the DMCA procedure described in this policy.


4. How to Submit a Takedown Notice

To submit a valid DMCA takedown notice, you must provide all six of the following elements. Section 512(c)(3) of the DMCA specifies these requirements; notices missing required elements may be disregarded or returned for correction.

4.1 Required elements

A valid takedown notice must include:

  1. Identification of the copyrighted work. Identify the copyrighted work you claim has been infringed. If you are reporting multiple works in a single notice, provide a representative list. Include enough information to identify the work: for example, the title of a photograph, the URL where the original was published, or the copyright registration number if registered with the Copyright Office.

  2. Identification of the infringing material. Identify the material you claim is infringing, with enough specificity for us to locate it on our platform. The best way to do this is to provide the direct URL(s) to the specific auction listing(s) that contain the infringing material.

  3. Your contact information. Provide your name, mailing address, telephone number, and email address so we can contact you about your notice.

  4. Good-faith belief statement. Include the following statement: "I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

  5. Accuracy statement and representation of authority. Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the copyright owner."

  6. Signature. Your physical or electronic signature. An electronic signature may consist of your typed name preceded by a statement such as "By: /s/ [Your Name]."

4.2 Sample notice format

The following is a sample format. You are not required to use this exact format, but your notice must contain all six elements above.

1. Copyrighted Work: [Description of the original work and, if available, a URL to the original or its registration number]

2. Infringing Material: [URL(s) to the specific pages on bingoauctions.com where the infringing material appears]

3. My Contact Information: [Name, mailing address, telephone number, email address]

4. Good-Faith Belief: I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

5. Accuracy and Authority: I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the copyright owner.

6. Signature: By: /s/ [Your Name], [Date]


4.3 Where to send your notice

Email (preferred): legal@bingoauctions.com — use the subject line "DMCA Takedown Notice."

Postal mail: RDW, LLC d/b/a BinGo Auctions, Attn: DMCA Designated Agent, [Mailing address on file with US Copyright Office].

We will acknowledge receipt of valid notices promptly, typically within 3–5 business days.


5. What Happens After We Receive a Valid Notice

Upon receiving a valid, complete takedown notice, we will:

  1. Remove or disable access to the content identified in the notice as expeditiously as reasonably practicable.
  2. Notify any affected party that the content has been removed and, where applicable, that they have the right to submit a counter-notice.
  3. Forward the notice where required or appropriate for the counter-notice process.
  4. Record the notice as part of our repeat-infringer policy tracking.

If a notice is incomplete, we may contact you for the missing information or may process a partial takedown if enough information is provided to identify the material.


6. Counter-Notice Procedure

If you believe content we removed in response to a takedown notice was removed in error — because you own the copyright, because you have a license to use it, or because the claimed infringement involves a fair use or other legal defense — you may submit a counter-notice.

6.1 Required elements of a counter-notice

A valid counter-notice under Section 512(g)(3) must include:

  1. Identification of the removed material. Identify the content that was removed and the URL where it appeared before removal.

  2. Statement under penalty of perjury. Include the following statement: "I swear, under penalty of perjury, that I have a good-faith belief that the material identified above was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."

  3. Your consent to jurisdiction. Include the following statement: "I consent to the jurisdiction of the federal district court for the district in which I reside (or, if I am located outside the United States, for any judicial district in which RDW, LLC may be found), and I will accept service of process from the person who provided notification to you."

  4. Your contact information. Provide your name, mailing address, telephone number, and email address.

  5. Signature. Your physical or electronic signature.

6.2 Where to send a counter-notice

Send counter-notices to legal@bingoauctions.com with the subject line "DMCA Counter-Notice."

6.3 Put-back timeline

If we receive a valid counter-notice, we will:

  1. Forward it to the original complainant and notify them that we will restore the content unless they file a court action within 10 to 14 business days.
  2. If the original complainant does not notify us within that period that they have filed a court action seeking to restrain the alleged infringement, we will restore the removed content.

We are not required to restore content if the counter-notice is incomplete or if we determine, in our reasonable discretion, that restoration would violate applicable law or our platform policies.


7. Repeat Infringer Policy

7.1 Termination for repeat infringers

Consistent with Section 512(i) of the DMCA, RDW, LLC maintains and enforces a policy of terminating accounts of users who are repeat infringers of copyrights in appropriate circumstances.

We track DMCA notices received and the accounts associated with content that is the subject of valid notices. A user who receives multiple valid takedown notices — particularly for the same type of content or pattern of infringement — may be subject to:

  • Temporary suspension of their account.
  • Restriction on submitting or posting new content.
  • Permanent termination of their account.

7.2 What counts as a repeat

We evaluate repeat-infringer status based on the totality of the circumstances, including the number of valid notices, the nature of the infringement, whether the infringement appears intentional or negligent, and whether the user responds to notices constructively. A single notice does not automatically trigger termination; a pattern of infringement does.

7.3 No vested right to continued service

Nothing in this Section creates any right to continued platform access. We reserve the right to terminate an account upon a single instance of egregious infringement (for example, systematically posting large numbers of photos that clearly belong to another business).


8. Misrepresentation Warning

Section 512(f) of the DMCA imposes liability on any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake. If you submit a takedown notice or a counter-notice knowing that the claims in it are false, you may be liable to the affected party for damages, including attorneys' fees.

Before submitting a notice or counter-notice, please consider carefully whether your claim is accurate. If you are uncertain whether you hold the rights you are claiming, consult an attorney before submitting.


9. Trademark Complaints

This DMCA policy does not cover trademark claims. If you believe a listing on BinGo Auctions infringes your trademark (for example, by offering counterfeit goods bearing your brand name), please contact us at legal@bingoauctions.com with the subject line "Trademark Complaint." Include:

  • The trademark at issue (word mark, logo, or both) and any registration number(s).
  • A description of the listing(s) you believe infringe the trademark, including URLs.
  • Your contact information and a statement of your authority to act.

We review trademark complaints under our own policies and will respond as promptly as practicable. Trademark complaints do not go through the DMCA counter-notice procedure.


10. Right of Publicity and Name / Likeness (NIL) Complaints

If you believe a listing on BinGo Auctions uses your name, image, voice, likeness, or other indicia of identity without authorization (a "right of publicity" claim), please contact us at legal@bingoauctions.com with the subject line "Right of Publicity Complaint." Include:

  • A description of how your identity is being used and in which listing(s), including URLs.
  • Your contact information and a statement of the basis for your claim.

Right of publicity claims are governed by applicable state law and are handled separately from copyright claims under this DMCA policy.
