Overview

This schedule ("Schedule A") lists categories of items that BinGo Auctions does not auction, sell, or offer for sale, under any circumstances, without express prior written authorization from RDW, LLC. This list is incorporated by reference into the Terms of Service (§5, available at /legal/terms).

The purpose of this schedule is to protect Bidders and BinGo Auctions from legal liability; to protect the integrity and reputation of the marketplace; and to ensure that the platform is not used to facilitate illegal activity. We recognize that many of the categories below involve items that are entirely legal to own in some form and in some jurisdictions — the prohibition is about the suitability of an open online auction marketplace as the transfer mechanism, not a judgment about ownership.

Where there is a question about whether a specific item that falls near a prohibited category should be permitted, an advance written exception must be requested from RDW, LLC at legal@bingoauctions.com. Exceptions are granted in writing only and apply to specific items or lot types, not to a category broadly.

Prohibited Categories

1. Firearms, Ammunition, and Related Items

Prohibited: Handguns, rifles, shotguns, and any other weapon that qualifies as a "firearm" under 18 U.S.C. § 921, whether operational or non-operational. Ammunition, cartridges, and projectiles intended for use in firearms. Conversion kits, auto-sears, bump stocks, forced-reset triggers, or other parts whose primary purpose is to modify a firearm's rate of fire.

Why: Federal law (the Gun Control Act, 18 U.S.C. § 922 et seq.) imposes strict requirements on firearms transfers, including mandatory federal firearms licensee ("FFL") involvement for most transfers, background checks, and recordkeeping. An online auction platform without FFL infrastructure cannot legally facilitate most firearm transfers. State law adds additional requirements in many jurisdictions.

2. National Firearms Act (NFA) Items

Prohibited: Silencers and suppressors, short-barreled rifles (SBR), short-barreled shotguns (SBS), machine guns, destructive devices, and any other item regulated under the National Firearms Act (26 U.S.C. §§ 5801–5872), including unregistered NFA items and any item that could constitute an unregistered NFA item under ATF interpretation.

Why: NFA items require ATF Form 4 or Form 3 transfer approval, background investigation, and a $200 tax stamp for most civilian transfers. Transfers without ATF approval are federal felonies. No online auction can process these transfers without direct FFL/SOT involvement.

3. Knives Prohibited Under Applicable State Law

Prohibited: Switchblade knives (automatic-open knives), ballistic knives, brass knuckles with integrated blades, and any other knife or bladed instrument whose sale or transfer is prohibited under applicable state or local law in the jurisdiction where BinGo Auctions operates or where the Bidder is located.

Why: State knife laws vary widely. Because BinGo Auctions Bidders are located across the United States, and because pickup may occur across state lines, the interstate transfer of knives that are prohibited in some states creates legal risk that the platform cannot mitigate at scale. Ordinary folding knives, fixed-blade knives, hunting knives, and kitchen cutlery are generally not covered by this prohibition.

4. Controlled Substances and Drug Paraphernalia

Prohibited: Any substance listed on Schedule I, II, III, IV, or V of the Controlled Substances Act (21 U.S.C. § 812), including but not limited to heroin, cocaine, methamphetamine, MDMA, fentanyl, and psilocybin. Drug paraphernalia as defined under 21 U.S.C. § 863, including pipes primarily intended for drug use, bongs marketed for that purpose, and rolling papers marketed with drug-use imagery.

Why: Distribution of controlled substances without DEA authorization is a federal felony. Paraphernalia sales are federally prohibited where intent to use with controlled substances is evident. The platform cannot verify the intended use of items in these categories.

5. Alcohol

Prohibited: Wine, spirits, beer, and any other beverage containing alcohol above the de minimis threshold regulated by applicable state alcohol control law, whether sealed, partial, or as part of a broader lot.

Why: The sale of alcoholic beverages is regulated by each state's alcohol control authority and typically requires a retailer's or auctioneer's liquor license. BinGo Auctions does not currently hold a license authorizing alcohol sales, and the platform does not have age-verification infrastructure suitable for alcohol transactions. If and when this changes, this category may be amended with appropriate safeguards.

6. Tobacco, Vaping Products, and Nicotine Delivery Systems

Prohibited: Cigarettes, cigars, pipe tobacco, smokeless tobacco, e-cigarettes, vaping devices and cartridges, nicotine pouches, and any other nicotine or tobacco product.

Why: Federal and state laws impose age-verification requirements (21+ under the Tobacco 21 federal law, PACT Act requirements for online sales, and additional state-specific regulations) that the platform does not currently support at the transaction level. We cannot reliably verify Bidder age at an online auction pickup.

7. Cannabis, CBD, Hemp, and Related Products

Prohibited: Cannabis in any form (including marijuana flower, edibles, concentrates, and infused products), regardless of THC content. CBD products derived from hemp. Hemp flower. Cannabis-related paraphernalia marketed for cannabis use.

Why: Cannabis remains a Schedule I controlled substance under federal law regardless of state legalization. Because the platform and its payment infrastructure operate across state lines and use federal banking and payment networks (including Square), cannabis sales on the platform create federal legal exposure. State cannabis sale laws also impose licensing requirements that differ by state and that BinGo Auctions cannot verify or administer. This prohibition applies even in states where cannabis is legal for adults.

8. Live Animals

Prohibited: Any live animal, including pets, livestock, poultry, fish, reptiles, insects, and birds.

Why: The sale and transport of live animals is regulated under federal law (Animal Welfare Act, Lacey Act), USDA regulations, and state animal welfare statutes. Online auction is not a suitable transfer mechanism for live animals. The platform has no infrastructure to ensure humane handling, transportation, or compliance with applicable veterinary and licensing requirements.

9. Human Remains, Organs, and Biological Materials

Prohibited: Human remains (whole or partial), bones, teeth (human), organs, tissue, blood, and other human biological materials.

Why: The sale of human organs is a federal crime under the National Organ Transplant Act (42 U.S.C. § 274e). The sale or transfer of other human biological materials is subject to extensive federal (FDA, CDC) and state regulation. These items are categorically inappropriate for an open consumer auction marketplace.

10. Endangered Species, Ivory, and Protected Wildlife Products

Prohibited: Products made from or containing parts of species listed under the Endangered Species Act ("ESA") or Appendices I or II of the Convention on International Trade in Endangered Species ("CITES"), including: elephant ivory (raw or worked), rhino horn, sea turtle products, coral, shark fin products, exotic cat pelts, and feathers of protected bird species. Items containing whale products.

Why: Sale, purchase, and interstate transport of ESA-listed and CITES-protected species and their parts is prohibited under federal law. Penalties include significant fines and imprisonment. The platform cannot verify the provenance or pre-ban status of such items at the time of listing.

Note on antiques and pre-ban items: Even items that may qualify as antique ivory or pre-ban wildlife products under narrow regulatory exemptions require specific documentation that cannot be reliably verified through an online auction listing. Where there is a genuinely exempt item, an advance written exception must be sought and documentation provided before listing.

11. Stolen Property

Prohibited: Any item that we know or have reason to believe is stolen, acquired through theft, obtained through fraud, or otherwise lacking a clean chain of title.

Why: Listing stolen property for sale constitutes receipt of stolen goods, which is a felony in all jurisdictions. We can only offer items to which we can transfer clean title. Items with incomplete provenance documentation in categories commonly associated with theft (power tools, electronics, jewelry, catalytic converters) may be flagged for additional review.

12. Counterfeit, Replica, and Infringing Goods

Prohibited: Any item represented as genuine that is counterfeit, including replica luxury watches, counterfeit designer handbags and accessories, fake currency (whether as novelty, prop, or otherwise), counterfeit electronics, counterfeit trading cards, and any item bearing a trademark that the seller is not authorized to use.

Why: Sale of counterfeit goods violates the Lanham Act (15 U.S.C. § 1124), the Trademark Counterfeiting Act, and many state consumer fraud statutes. It also exposes BinGo Auctions to secondary liability and potential seizure of platform operations. Clear replicas sold and described honestly as replicas (not as genuine) may be permitted for specific use cases (theatrical props, art) with an advance exception.

13. Government Property Without Release Authority

Prohibited: Government-issued equipment, uniforms, identification documents, insignia, or property — including military gear, law enforcement equipment, and postal service items — unless documentation can be provided establishing that the item was lawfully obtained as surplus property through a government property release program.

Why: Unauthorized possession and transfer of government property may violate 18 U.S.C. § 641 (theft or conversion of government property), as well as regulations governing military surplus and law enforcement equipment. Without documented release authority, the platform cannot support the transfer.

14. Hazardous Materials

Prohibited: Items that present a hazardous materials risk in a consumer pickup and resale context, including:

• Damaged or swollen lithium-ion batteries in consumer electronics, e-bikes, or energy storage devices.
• Bulk quantities of flammable liquids or gases above household quantity thresholds.
• Unlabeled or unidentified industrial chemicals.
• Pesticides and herbicides without complete labeling.
• Asbestos-containing materials.
• Items containing regulated quantities of lead or mercury without appropriate disclosure.

Why: Federal and state hazmat regulations (DOT, EPA, OSHA) impose requirements on the transfer, handling, and disposal of hazardous materials. Consumer auction pickup is not an appropriate transfer mechanism for items posing realistic safety hazards to Bidders, our staff, or the public.

Note: Consumer electronics in good working condition containing lithium batteries (laptops, phones, cordless tools) are not prohibited by this section. The prohibition targets damaged batteries and bulk/industrial quantities of flammables and chemicals.

15. Recalled Consumer Products

Prohibited: Any consumer product subject to a mandatory or voluntary recall by the U.S. Consumer Product Safety Commission ("CPSC"), a manufacturer, or another regulatory authority, where the recall has not been remedied (i.e., the product has not been repaired, replaced, or modified to address the recall condition).

Why: Selling a recalled product with an unresolved safety defect exposes the seller, the platform, and potentially the Bidder to serious harm and legal liability. We check the CPSC recall database (https://www.cpsc.gov/recalls) before listing consumer products, particularly in categories commonly subject to recall (children's products, furniture, power tools, appliances, car seats, cribs, and similar goods).

16. Medical Devices and Prescription Items

Prohibited: FDA Class II and Class III medical devices requiring physician supervision or prescription for safe use, including but not limited to: implantable devices, powered wheelchairs requiring prescription, diagnostic equipment requiring clinical calibration, and any device labeled "Rx Only." Prescription pharmaceuticals and drugs requiring a prescription.

Why: FDA regulations (21 C.F.R.) restrict the sale of prescription devices and drugs to licensed distributors and pharmacies with appropriate prescriptions. Consumer resale of prescription medical devices and drugs without authorization violates the Federal Food, Drug, and Cosmetic Act. Over-the-counter medications, non-prescription assistive devices, and general wellness products are not covered by this prohibition.

17. Financial Instruments and Related Items

Prohibited: Lottery tickets. Gift cards or stored-value cards offered for sale above their face value, or gift cards of uncertain or unverifiable balance. Securities, stocks, bonds, options, or other financial instruments regulated by the SEC or FINRA. Casino chips, tokens, or credits. Foreign currency above de minimis amounts without a currency exchange license.

Why: Each of these subcategories is subject to its own regulatory regime (state lottery law, state money transmission law, securities law, gaming regulation). The platform is not licensed to facilitate any of these financial transfers.

18. Hate Group Memorabilia and Extremist Content

Prohibited: Items bearing symbols, insignia, or content associated with designated hate groups, white supremacist organizations, or organizations designated as terrorist organizations by the U.S. government. This includes items whose primary market appeal is their association with hatred of a protected group.

Why: Such items create legal risk (including under civil rights statutes in some states), undermine the safety and inclusivity of the marketplace, and expose BinGo Auctions to reputational harm. Items whose prohibited character is incidental (for example, a piece of 1930s European political propaganda sold to a documented collector or museum) may be considered for an advance exception with full context.

Note on genuine WWII-era relics: Authenticated historical military items (medals, uniforms, insignia) from WWII and other historical conflicts are considered on a case-by-case basis. Nazi-era items bearing prohibited symbols may be listed only if the listing is clearly framed in a historical and educational context, accurately describes provenance, and includes language making clear the items are not offered to celebrate or promote their historical association. Listing such items requires an advance written exception from RDW, LLC.

19. Used Cosmetics, Intimate Apparel, and Pierced Jewelry

Prohibited: Used cosmetics, makeup, skincare products, or personal care items that cannot be verified as sealed and unexpired. Used underwear, used swimwear, and similar intimate apparel. Used pierced jewelry (earrings, nose rings, and similar items) where the integrity of the piercing surface cannot be verified as sanitized.

Why: These items present genuine sanitary and public health concerns in resale. Bidders at an online auction cannot inspect condition before purchase, and the risk of contamination or disease transmission from personal care items is not manageable in a pickup-only fulfillment model without clinical sanitization documentation.

20. Items Requiring Federal License to Transfer

Prohibited: Items whose transfer to a private party requires a federal license that BinGo Auctions does not hold and that cannot be transferred at a consumer pickup event. This includes, without limitation:

• FCC-restricted radio transmitters or jammers requiring FCC authorization for civilian possession.
• Export-controlled items (EAR / ITAR regulated technology or munitions) without documented export license authority.
• DEA-scheduled controlled substances (see Section 4 above).

Why: These items cannot legally change hands through a standard consumer transaction without the specific regulatory infrastructure to authorize the transfer. The platform cannot provide or verify that infrastructure.

21. Political Access and Vote-Related Items

Prohibited: The sale of votes, political access, elected-official introductions, or any item or service whose transaction would constitute a bribe or unlawful contribution under federal or state law.

Why: Such transactions violate federal election law (52 U.S.C. § 30121 et seq.), the federal anti-bribery statute (18 U.S.C. § 201), and their state equivalents. The platform will not facilitate transactions that have any appearance of political corruption.

22. Adult Content

Prohibited: Sexually explicit images, videos, or written content. Nudity in listing photos, thumbnails, or descriptions. Items marketed primarily for sexual use that would not be appropriate in a general-audience retail environment.

Why: BinGo Auctions is a general-audience marketplace. Our mobile applications are available on the Apple App Store and Google Play, which prohibit adult content. Our Bidder base includes a broad public audience. We are not an adult content marketplace and do not have the age-verification and access-restriction infrastructure required to responsibly host adult content.

23. Items Violating State Consumer Protection Law

Prohibited: Any item or transaction that would violate applicable federal, state, or local consumer protection law, deceptive trade practices statutes, or unfair business practice laws in the jurisdiction where BinGo Auctions operates or where the Bidder is located. This includes, but is not limited to: items subject to mandatory manufacturer warranties that cannot be transferred, items with material non-disclosed safety defects, and items sold under deceptive descriptions designed to mislead Bidders.

Why: This is a catch-all provision. Consumer protection laws exist to protect buyers from deceptive and dangerous transactions. Even where an item category does not appear elsewhere on this list, listing it in a way that violates consumer protection law exposes BinGo Auctions to regulatory action and civil liability.

Consequences of Listing a Prohibited Item

If BinGo Auctions identifies or is notified that a listing contains a prohibited item:

• The listing will be immediately removed from the platform.
• The reason for the removal will be documented internally.
• If the auction containing the lot has closed with winning bids on the prohibited lot, we are responsible for cancelling those transactions, notifying affected Bidders, and processing any refunds.

Items prohibited as a matter of federal criminal law (firearms without FFL involvement, controlled substances, NFA items, CITES-protected species, stolen property) are never listed and, where discovered in inventory, are removed from the sales channel and, where appropriate, referred to law enforcement.

Requesting an Exception

Where there is a question about whether a specific item in or near a prohibited category should be permitted for a specific Auction or Lot, contact RDW, LLC at legal@bingoauctions.com before listing the item. The request must describe the item in detail, explain why it does not fall within the prohibition or why an exception is appropriate, and provide any supporting documentation. We will respond within a reasonable time.

Exception requests must be granted in writing before the item is listed. Listing an item while an exception request is pending does not constitute approval. We are under no obligation to grant any exception.

Currency of This Schedule

This Schedule is effective as of the date shown at the top of this document. We update it as laws change, as new product categories create new legal risks, and as platform policy evolves. The version posted at /legal/prohibited-items is the current, controlling version.
